Tax practitioners have told Law360 that Gresham's complaint typified the frustrations taxpayers have experienced during the last few years as cases have languished amid a drop-off in ALJs. They are waiting to see how the federal court will handle Gresham, and particularly if it will provide some relief, said Jeffrey Reed, tax partner at Kilpatrick.

Reed noted that companies generally must exhaust administrative remedies before moving on to a court. And when they do, they must generally stay in the state or local jurisdiction as long as that jurisdiction affords "a speedy and efficient remedy."
